The Project-Zone service and network (collectively, "Project-Zone" or "the Service") are operated by Bertrand3D consulting. and its corporate affiliates (collectively, "us", "we", "the Corporation" or "the Company"). By accessing or using our web site at www.project-zone.co.za or by posting a link on your site, you (the "User") signify that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are a registered member of Project-Zone. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page. The date of this revision will also be an indication of when these terms were last revised. Registration Data and Login Information

The Service and the Site are available for your personal, non-commercial use only. This excludes advertising programs offered by us. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory or otherwise unlawful material.

You also agree not to use the Service or the Site to:

- Use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site.

- Make available by uploading, posting, transmitting, sharing, storing or by any other means any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.
- Register for more than one user account.
- Register for an acccount on behalf of any individual, group or entity other than yourself.
- Misrepresent yourself, any personal information or other information.

- Upload, post, transmit, share or make available any unsolicited or unauthorised advertising, solicitations, promotional materials, "junk mail" or "spam".
- Make available any private information of any third party.
- Make avialable any content that would provide instructions on or be a criminal offence or violate any local, national or international law.
- Use or attempt to use another users account.
- Make available any content that could expose the Company or users to harm or liability. 

Content Posted to Site

You are solely responsible for any and all content that you upload, publish, display or post on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the Company violates this Agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.

When you post User Content to the Site, you authorise and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence (with the right to sublicence) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorise sublicences of the foregoing. We do not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.

This site or Service may contain links to third party websites or content. We are not responsible for any third party websites or contents. You should review the terms and conditions of the third party website or content.

Classified Advertisments and Any Other Sales

Parties to a transaction are solely responsible for all interactions with each other, for arranging for payment and the exchange of the goods or services purchased if applicable, and for the results and performance of any transaction or relationship entered into through Project-Zone. You acknowledge that we are not responsible or liable for any action or inaction of any party to a transaction, for any failure to perform, to pay any amounts due, or to deliver any merchandise or services as promised, or for any other aspect of the transaction. Use of the Site is provided at your own risk.

Terms of Sale

Products or services might be made available for sale by Project-Zone. By purchasing any products or services you agree to be bound by these terms of use and terms of sale. Do not make any purchases if you do not agree to these terms of sale.

- You accept that you are responsible for any purchases made on your user account.
- Project-Zone reserves the right to cancel orders, refuse to sell or close accounts at any time.
- FOB shipping will apply to any goods.
- Title passes to you upon shipment.
- You accept that you will be responsible to pay taxes, fees and other duties that might be applicable.

Returns

- Will only be considered if we received notification within 10days of delivery.
- A 20% restocking fee may be charged.
- You will be liable for the return shipping, duties, taxes and fees.
- We are not responsible for damage during shipping. Goods have to be inspected on delivery by the shipping company.
- returns are subject to a written approval from the Company before return shipping can commence.

Disclaimer

- Warranty on third party products or services are given by the manufacturer or service provider and not the Company.
- Unless otherwise stated the company does not make any claims regarding warranty on any product.
- Unless otherwise stated all product and services are provided "as is'.
- The Company does not accept any liability for the conduct of any of the Site's users whether online or offline.
- The site may be offline temporarily for maintenance and the Company does not accept any responsibility for losses or damages due to this.
- The operation of the site may be suspended at any time and the Company does not accept any responsibility for damages or losses due to this.

Limitation on Liability

Unless otherwise prohibited by applicable law the Company, affiliates, owners or employees do not accept any liability for any indirect, consequential, injuries, damages or losses. Under all circumstances the liability of the company will be limited to the amount paid by you for the goods or service.

Indemnity

You agree to indemnify and hold the Company, its subsidiaries and affiliates, and each of their owners, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with your purchase or use of any product or services, or any violation of this Agreement or of any law or the rights of any third party.

Governing Law

By using the Site and / or Service you agree that the laws of South Africa will govern your use of the Site / Service and all interactions and disputes arrising from that. You also agree to not proceed with any action against the Company in any other courts than in South Africa.
